AFFIDAVIT
The
undersigned says that, to the best of his/her/their knowledge and
belief:
1.
The undersigned is/are the record title holder(s) of the property known
and described in Comrnitrnent For Title Insurance issued by Southern Title
Insurance Corporation referred to below (the property).
2.
The property is residential and used as one single family residence.
3.
The Street Address of the property is as shown below.
4.
At no time within 123 days prior to the date of settlement has any
work, services or labor been done, or any fixtures or material been furnished
in connection with, or to, the property, except such material, fixtures, work,
labor or services as have been fully and completely paid for.
5.
There are no person(s), firms or other parties in or entitled to
possession of the property other than the undersigned.
6.
The undersigned is not currently in any bankruptcy proceeding in any
State or Federal court.
7.
The undersigned, if married, have been continuously married to each
other since the undersigned first took title to the property.
8.
Since the undersigned has owned the property, there have been no unpaid
or delinquent (a) real estate taxes or assessments against the property; (b)
drainage, water or sewer service charges against the property; or (c)
homeowners’, condominium or other special assessments against the property.
9.
The undersigned is not aware of any (a) violations(s) of any zoning or
subdivision law or ordinance; (b) violation(s) of any restrictive covenants
affecting the property; (c) encroachment(s) of any improvements located on the
property, including but not limited to walls and fences, onto adjoining
property, easement or utility area, and no encroachment(s) upon the property
from adjoining property; (d) problems relating to either the issuance of a
building permit or the failure to obtain one for any improvement to the
property; (e) violation(s) caused by an illegal lot division or failure to
comply with any subdivision laws or ordinances.
10. No one has ever attempted to restrict or prohibit my access to and
from the property to a public street.
11. This Affidavit is made to induce Southern Title Insurance Corporation
to issue “The Southern Advantage”
Homeowner’s Title Insurance
Policy.
